These terms are the agreement between you and Zimi. They cover what you can expect from us, what we expect from you, and what happens when something goes wrong. By creating an account or using the app, you agree to them.
You must be at least 21 years old to use Zimi. Zimi is about alcoholic drinks, 21 is the legal drinking age in the United States, and we ask you to confirm your age before you use the app. If you are under 21, do not use Zimi. Confirming an age that is not yours is a breach of these terms, and we will close the account when we find out.
You also need to be able to form a binding contract, and you must not be barred from using the service under the laws that apply to you.
Zimi carries content created by its users: ratings, written reviews, photos, lists, and profile details. You own what you post, and you are responsible for it.
There is no tolerance for objectionable content or abusive behavior on Zimi. Accounts that post objectionable content or harass other users are removed. Specifically, do not post or do any of the following:

If you see something that breaks these rules, report it in the app or email support@zimitaste.app.
You keep ownership of your reviews, photos, and other content. By posting to Zimi, you give us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for display, and show that content in the app and on our website, for the purpose of operating and promoting Zimi. This license ends when you delete the content or your account, except that copies may persist in backups for a limited period, and aggregated ratings that no longer identify you may remain.
You confirm you have the rights to everything you post, and that posting it does not break the law or anyone else’s rights.
Zimi, its name, its logo, its design, its software, and the writing we publish about drinks and ingredients are ours or our licensors’. The catalog is a different matter. Plain facts about a bar or a drink, such as a venue’s name and address or what it charges for a cocktail, are not ours and we claim no ownership of them. What is ours is the collection we assembled: which venues and drinks we gathered, how we organized and enriched them, and the flavor data and ratings built on top. We give you a personal, limited, non-transferable, revocable license to use the app for its intended purpose. That license does not include the right to copy our software, resell access, or scrape the catalog to build a competing product.
Zimi predicts what you might enjoy based on the ratings you and other people give. Those predictions are opinions and estimates, and they will sometimes be wrong. Menus change, recipes vary by bartender, and a venue may not serve what we show.
Nothing in Zimi is medical, dietary, or allergen advice. Ingredient lists are user-contributed and can be incomplete or wrong. If you have an allergy or a medical condition, ask the venue directly before ordering.
Drink responsibly. You are responsible for your own decisions about alcohol, including how much you drink and how you get home. Zimi does not encourage excessive drinking and is not responsible for what happens when you follow a recommendation.
Zimi lists bars, restaurants, and other venues we do not operate. We are not responsible for what they serve, what they charge, how they treat you, or whether they are open. Business accounts that claim a venue take on responsibility for the accuracy of what they publish about it.
We may change, suspend, or discontinue any part of Zimi at any time. We will try to give notice of significant changes when we reasonably can. We do not promise the service will be uninterrupted or error free.
You can stop using Zimi and delete your account at any time from Settings. We may suspend or close your account if you break these terms, if we are required to by law, or if keeping the account open would create risk for other users or for us. Sections covering rights in content, disclaimers, limitation of liability, and governing law survive the end of this agreement.
Zimi is provided on an "as is" and "as available" basis. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about the accuracy or reliability of drink data, venue data, ratings, or recommendations.
To the fullest extent the law allows, Zimi and its team are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or personal injury, arising from your use of the service. Our total liability for any claim relating to Zimi is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
Some jurisdictions do not allow these limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
You agree to cover our reasonable costs, including legal fees, if a third party brings a claim against us because of content you posted, your use of Zimi, or your breach of these terms.

These terms are governed by the laws of the State of Florida and the applicable federal laws of the United States, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to that jurisdiction.
We may update these terms as the product changes. When a change materially affects your rights, we will update the effective date at the top and tell you in the app before it takes effect. Continuing to use Zimi after a change means you accept the updated terms.
